FirmOffer LLC is a Texas limited liability company headquartered in San Antonio, Texas. We provide a software platform that enables dealerships to contact their service customers via SMS to facilitate vehicle trade-in offers. FirmOffer acts as a service provider on behalf of the dealerships that use our platform.

FirmOffer does not use customer data for marketing purposes unrelated to the dealership's trade-in program, and we do not sell, rent, or trade personal information to any third party.
FirmOffer sends SMS messages on behalf of dealerships to their existing service customers. The legal basis for these messages is the existing business relationship between the dealership and the customer — customers have previously provided their phone number to the dealership in connection with vehicle service.
Every message sent through FirmOffer identifies the dealership and the sender by name. Every initial message includes a clear opt-out instruction. Customers may reply STOP at any time to opt out of further messages. Customers who have opted out may reply START to opt back in.
FirmOffer does not send automated promotional messages. All trade-in offers are reviewed and sent manually by a human appraiser. No offer amount is auto-generated or sent without appraiser approval.
Standard message and data rates may apply depending on the customer's mobile carrier plan.
FirmOffer retains customer interaction data — including contact information, vehicle details, SMS conversation history, and offer amounts — on behalf of the dealership. This data is retained for the lifetime of the dealership's account with FirmOffer to enable appraisers to reference prior interactions and offers when a customer returns for future service visits.
Upon termination of a dealership's account, all customer data associated with that account will be automatically and permanently deleted within 30 days of the termination date. This includes contact information, vehicle details, SMS conversation history, offer amounts, and all related interaction records. Dealerships are encouraged to export any data they wish to retain prior to account termination, as this deletion is irreversible.
FirmOffer does not sell, rent, or share personal customer data with third parties for their own marketing or commercial purposes. We may share data with the following limited categories of service providers solely to operate our platform:
All third-party providers are contractually required to use customer data only to perform services on FirmOffer's behalf and may not use it for any other purpose.
FirmOffer implements reasonable technical and organizational measures to protect personal information against unauthorized access, disclosure, alteration, or destruction. These measures include encrypted data transmission (HTTPS/TLS), access controls, and secure hosting environments.

FirmOffer is a business-to-business platform intended for use by licensed automobile dealerships and their adult customers. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have collected data from a minor, we will delete it promptly.
